Insurance

Whether you buy Homeowners, Auto, Errors & Omissions, Directors & Officers, or General Commercial Liability insurance coverage, you make the decision for peace of mind, as your safety net for unforeseen catastrophe. Your policy is a contract designed to ease your worries if a disaster strikes, such as a fire, flood, storm, an error, or mistake that results in damage to your house, cars, or your business.

Bad Faith and Unfair Claims Handling of Insurance Claims

When you buy an insurance policy, the insurance agent describes what coverage is provided by your premium and you then sign on the dotted line. Fortunately, many people never experience disaster and consequently never need to file an insurance claim for damages. However, when the need to file a claim arises, and when your insurance adjuster explains that the fine print on your policy does not cover your claim, you may understandably feel betrayed. Or, the insurance adjuster will neglect your case and never return your calls. Insurance companies are obligated to do business with the customer in good faith. Strict laws protect consumers from insurance sales misrepresentation and require insurance carriers to be responsive to their policyholders. If you were led to believe your policy covered certain occurrences, and the insurance company is not responding in good faith, you may have grounds for a bad faith or unfair claims-handling lawsuit against the insurance company.

Wrongful Denial of Claims

In some instances, insurance companies will deny claims for which their policies clearly promise coverage. An adjuster evaluates claims and makes coverage decisions based upon the guidelines established by the insurance carrier. And, unfortunately, creating guidelines which favor the insurance carrier causing the adjuster to deny claims, is an insurance tactic used by insurance carriers to boost the companies’ bottom lines. Reducing the number of claims an insurance carrier pays ultimately cuts expenses for their company. Normally, insureds do not contest a denial, thinking there is nothing that can be done. Insurance companies often rely on the insured’s acceptance of the adjuster’s decision regarding a wrongfully denied claim as final. Wrongful denials should be contested, and an attorney skilled in dealing with such claims can be invaluable in protecting your rights.

Insurance companies are held liable for mistreating insureds and must pay benefits outlined in insurance policies. In some cases involving consumer abuse, the court may award additional damages and attorney fees over and above the ordinary compensation that should have been awarded according to the policy.
